Terms & Conditions Print this page 1.Custom Clearance: Customs clearance is the service of clearing customs by a custom clearing agent. Unless otherwise specified on your Description of Services, with our door-to-door shipments the regular customs clearance formalities will be handled by the appointed customs broker at your destination and is included in your agreement with RSS LLC. If applicable, the following item/items may be invoiced to you overseas. These items include, but are not limited to: customs related charges, destination local government agencies fees, duties or taxes if any. RSS LLC has sent you the most recent customs regulations for your destination, however customs regulations are subject to change at any time. It is the consignee’s full responsibility to check with the local embassy or consulate at origin for any regulatory requirements and obtain & provide all documentation needed for custom clearance. It is your responsibility to ensure that the shippers name correlates with all documentation necessary for custom clearance (ex: passport, visa etc.) Non-compliance may result in serious customs penalties and delays at consignee’s own expense. RSS, LLC and/or Carrier cannot be held liable for any costs associated with non-compliance. Customs may request the owner of goods to be present at time of customs clearance. RSS LLC and/or Carrier and/or their agents cannot change and/or influence customs decisions. Please refer to the customs regulations sent to you and be sure that you do not load any prohibited items inside your container which will raise flags with customs at origin or destination. In addition, many carriers will not accept the following items: weapons, ammunition, alcohol, illegal drugs, pornography, cash, tobacco, etc. It is extremely important that these items are not loaded in to the container because if these items are discovered the fines and penalties are extremely high and can be anywhere from $25K to $250K which will be for your account. In addition, it is extremely important that your inventory list reflects your actual piece count loaded inside the container. Each box and each unboxed item need to be on your inventory sheets. Failure to declare items could also result in fines, penalties, customs seizure of the goods. Equipment Shortages Due to the possibility of equipment shortages at all US Ports and Depots, RSS, LLC cannot be liable for pick-up/loading delays, including steamship line schedule changes. We continuously monitor the schedules with the carriers/ports however, if your container is loaded and the changes are received after loading, RSS LLC has no choice but to store the container at the trucker’s yard until the vessel opens for receiving. Unfortunately, storage, chassis fee, redelivery fee and possibly demurrage will be added to your account. Although we do not anticipate any delays, please do not book your flights on the day of or after your scheduled pickup. Allow a 2 to 3-day window. RSS, LLC and/or Carrier shall not be held liable for delays caused by port/terminal congestion or caused by breakdown of mechanical defects of vehicles, weather conditions, traffic or equipment, or from any cause other than negligence of the carrier; nor shall the carrier be bound to transport by any particular schedule, means, vehicle or otherwise then with reasonable dispatch. The carrier reserves the right in regards to the routing, method of transportation, selection of carrier and delivery agent. The carrier shall have the right in the case of physical necessity to forward said property by any carrier or route between the point of origin and the point of destination. Transit time is never guaranteed. The estimated time of arrival in most cases is 30 to 55 days is not guaranteed and is only an estimate based on compiling past experience of shipping time frames. 3. Limited Liability By signing this contract, the consignee fully acknowledges that any and all contract-based and/or tort-based claims under this contract are fully assigned to the carrier. The consignee fully acknowledges that RSS, LLC cannot be held vicariously liable for the errors and omissions of others. This contract unambiguously states that any and all disputes arising from this contract are between the consignee and the carrier, and not RSS, LLC. RSS, LLC shall under no circumstances be liable for any loss, damage, expense or delay to the goods for any reason whatsoever when such goods are in the custody, possession or control of third party selected by RSS, LLC to forward, enter and clear, transport or render other services with respect to such goods. 4. Road Restrictions and Permits Consignee should check with their municipality at origin and destination to inquire as to whether a permit is required. It is the shipper’s responsibility to obtain any permits or special restriction authorization from the local police or other authorities if required. 5. Vehicle/Boat/Motorcycle If exporting motorized units, you must disclose this information to us prior to reserving your move as not all carriers accept motorized units (cars, motorcycles, scooters, etc). The original title must be received by our US Customs Broker 5 days prior to your move date. You will receive instructions on where to send your original title (free and clear title -no liens). The name on your title must match the shippers (consignee’s) name. You may be required to provide a signed notarized power of attorney letter. If required, we will provide the power of attorney form to you. Late receipt of your original title may result in customs penalties. For more details, please contact your sales rep. If your vehicle is being shipped using Roll On Roll Off service (not containerized), US Customs only permits a spare tire and jack to ship inside the vehicle. Any other items loaded or located inside the vehicle will be at customer’s own risk. Vehicles are held for a minimum of 72 hours at the US Exit port for title clearance, any extension of this time for clearance will result in storage and demurrage charges on your shipment. RSS, LLC and/or the Carrier shall not be held liable for any delays or costs imposed by customs. ***YOU MUST ADVISE US PRIOR TO BOOKING IF YOU ARE SHIPPING AN ELECTRIC/HYBRID VEHICLE BECAUSE THE SHIPMENT WILL NEED TO BE SENT AS A HAZARDOUS COMMODITY. NOT ALL CARRIERS WILL ACCEPT AN ELECTRIC/HYBRID VEHICLE 6. Insurance Information Upon receipt of your reservation, you will be emailed an insurance form with options and rates. Your insurance certificate will be filed based on your declaration of the shipment’s value. All terms and conditions will be as per your insurance policy. All claims, if any, should be submitted by you directly to the insurance company. RSS, LLC and/or Carrier are not your insurance brokers, nor your insurance company, and will not be responsible for any claim you may have. Please note, that by choosing not to insure, you are waiving your right for compensation in case of damage or loss. If you choose not to insure you hereby declare that RSS, LLC and/or Carrier has offered you to purchase marine insurance to cover your shipment which you have declined. You hereby further declare that if you decline to purchase the insurance offered to you, neither you nor any person or entity acting on your behalf shall assign, grant, authorize or allow any subrogation of your rights against RSS, LLC and/or carrier in connection with your shipment, and you shall indemnify RSS, LLC and/or Carrier for any loss they incur if you breach your agreement here-under or as a result of any claim or action of subrogation or otherwise asserted by any third party in connection with your shipment. Payment Options We accept checks (personal or business), wire/ACH transfers, and all major credit cards (Visa, MasterCard, Discover or American Express). All payments are to be paid in U.S. funds. If you choose to use a credit card for payment, a processing fee of 3% will be accessed. A non-sufficient check issued to RSS, LLC and/or your carrier will incur a $150.00 USD non-sufficient check fee. The fee for wire transfers is $35. Final payment in full must be made on the day of the move or upon receipt of our invoice. If remitting your deposit and/or balance over the phone, you are hereby authorizing RSS LLC to electronically debit your account. Any and all disputes must be handled through the RSS, LLC accounting department. Customer acknowledges that they are waiving their right to dispute charges / payments made on their debit/credit card/bank account. Any and all refunds will be handled through the corporate accounting office. If a refund is warranted, the customer will be mailed a company check once the claim(s) has been investigated. If you wish to contest any fees or file a claim, please e-mail claims to info@rssllc.net. 8. Pricing Adjustments Pricing adjustments may be made due to fuel surcharge increase, currency exchange rate increases, etc. Once your shipment sails, if any information needs to be changed (consignee name/address/phone #/ piece count/etc.) there may be an administrative amendment charge from the steamship line. If they charge the amendment fee, this will be for your account. 9. Cancellation Policy All cancellations must be submitted in writing at least 2 weeks prior to your move date. Deposits are non-refundable. Deposits do not expire and you can choose to transfer it to the person of your choice. 10. Expiration The rates and services on your estimate are valid for a period of up t0 30 days. If your contract and reservation payment information is not received within 30 days, your rate may be subject to change. 11. Carrier Information Your carrier will be assigned prior to your pick-up date. RSS, LLC reserves the right to re-assign carriers without notice or cause. This Service Contract is fully assigned to a designated carrier (NVOCC)/Steamship Line. All carriers are licensed and bonded through the FMC. 12. Trucker Detention Time Unless otherwise specified, we include 3 hours for the trucker’s standby time while the container is being loaded. Actual detention charges, if any, is billed after the loading is completed. This applies to both self-load and if our crew is loading the container. Unfortunately, we cannot estimate loading time in advance, therefore cannot include any detention charges with your original quote. 13. Loading Crew If you have contracted with us to load your container, most containers can be loaded within the free hours included in the pricing you've received. Certain situations may result in additional time needed for loading. The loading crew has been reserved for up to 3 hours. If additional time is needed to load your goods into the container, additional labor charges will apply and will be billed to the customer as outlined on your proposal/reservation agreement. RSS LLC is not responsible for loss or damage to the following items if loaded in to the container: Valuable papers, stamp collection, currency, coin collection, valuable jewelry, fire arms, etc. 15. Self-load Shipments If your shipment is set up as self-load, please keep in mind that the container sits up on a chassis and is therefore approximately 57 inches off the ground. The container will not be lowered to the ground unless arrangements are made for special equipment ahead of time. The containers do not come with ramps. 16. Inventory List An inventory list is required for all international shipments. If you have not received our blank inventory sheets, please contact our office. Every box and each loose item loaded inside the container must be listed on our inventory sheets. Your inventory sheets must be faxed, emailed or uploaded to your shipper/consignee profile (SHIPPER / CONSIGNEE PROFILE) immediately following the loading. This information is needed for completion of your sailing documents. If the inventory sheets are not received in time, and we need to amend the sailing documents, the steamship line may charge an administrative amendment fee which will be for your account. 17. Port to Port/Door to Port Shipments The following applies only to port to port & door to port shipments. Please be reminded that all destinations require a shipment to clear customs upon entering the country. It is understood that with the port to port and door to port shipments, it is your responsibility to handle and/or arrange the customs clearance overseas. The service agreement between RSS LLC and the shipper ends upon arrival at the destination port. ** This does not apply to Door to Door moves. 18. LCL (Less than Container Load) Shipments The price you have been quoted is based on your request. All LCL shipments are measured upon arrival to the consolidated warehouse. If the actual volume if different from your estimated volume, you will be billed/credited for the difference. If you have chosen the terminal-to-terminal shipping option, your goods should be palletized prior to drop off. If you are unable to palletize your boxed cargo, the warehouse may offer this service for an additional fee. 19. Transit Time The ETD (estimated time of departure) and ETA (estimated time of arrival) are based on the information received directly from the steamship lines and our past experience shipping to your destination. While we do not foresee any changes, the steamship lines do have the right to make schedule changes when necessary. In most cases shipments take about 25 to 55 days to arrive. Your ETA will be provided to you upon request and included in your sailing confirmation sent by our office. RSS LLC cannot be held responsible for any delays in transit including customs holds, port strikes, equipment shortages, port congestion, and any other delays that may occur that are out of our control. 20. Destination Charges (DTHC/PORT FEES) Consignee is responsible to pay for the destination charges directly to the overseas agent unless agreed otherwise. Port Fees and DTHC are not included in what you have paid RSS LLC unless otherwise stated on your proposal/reservation agreement. These fees vary on the shipping line used. Port Fees may include but are not limited to the following items: DECONSOLIDATION FEES, ISPS, LINER FEE/BL FEE/ECS FEE, HARBOR DUES, CSC, NVOCC CHARGES, WAREHOUSE HANDLING, CONTAINER IMBALANCE FEE, DEVANNING, DELIVERY ORDER, CONTAINER DEPOSIT AT DESTINATION (REFUNDED), LOG FEES, ETC. IMPORTANT Upon completion of packing and/or loading, and prior to the container leaving your residence or loading site, the customer agrees to conduct a walkthrough of the premises to ensure that everything that is being shipped has been packed and/or loaded in to the container. We, RSS LLC., cannot be held responsible for items left behind. It is the customers responsibility to notify our crew immediately if an item was missed and this must be done prior to the container leaving your site.
